Day Hike Terms of Service

1. Introduction

Welcome to Day Hike! These Terms of Service (“Terms”) govern your use of the Day Hike mobile application (the “App”), website, and related technology or services (collectively, “Day Hike Technology”). By downloading, installing, or using Day Hike Technology, you agree to be bound by these Terms. If you do not agree, do not use Day Hike Technology.

2. User Eligibility

You must be at least 18 years old to use Day Hike Technology. If you are 13–17 years old, you may only use the App with verifiable parental or guardian consent. The App is not directed to children under 13, and we do not knowingly collect personal data from children under 13.

3. Account Registration

Certain features require an account. You must provide accurate, current, and complete information and keep it updated. You are responsible for maintaining the confidentiality of your account and password and for all activity under your account.

4. User Conduct

You agree not to:

  • Violate any laws or regulations.

  • Impersonate others or misrepresent your affiliation.

  • Post unlawful, infringing, defamatory, obscene, or abusive content.

  • Harass, stalk, or harm other users.

  • Interfere with or disrupt Day Hike Technology or connected networks.

5. Content Ownership

All content provided by Day Hike is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license for personal, non-commercial use.

6. User-Generated Content

By submitting content, you grant Day Hike a worldwide, perpetual, irrevocable, royalty-free, sublicensable, transferable license to use, reproduce, distribute, display, and adapt that content in connection with Day Hike Technology.

7. Privacy Policy

Your use is governed by our Privacy Policy, which explains how we collect, use, and share your data. By using Day Hike Technology, you consent to these practices.

8. Location Services

The App, website, or any other Day Hike technology may use location-based services to provide certain features and functionalities. By using the App, website, or any other Day Hike technology, you agree to the collection, use, and sharing of your location data as described in our Privacy Policy. Location data may be used to:

  • Provide you with relevant information and recommendations based on your current location.

  • Improve the accuracy of the App, website, or any other Day Hike technology’s features and services.

  • Enable location-based social interactions and sharing with other users.

8.1 Precise Location Option

You may choose to enable or disable Precise Location through your device or in-app settings. When enabled, Precise Location allows the App to collect and use your exact location (e.g., GPS-level accuracy) to provide enhanced features such as accurate map placement, nearby activity suggestions, and location-based social interactions.

When Precise Location is enabled, your profile may also be shown to other users who are nearby or viewing the map. You can also customize or disable your location sharing in your in-app privacy and visibility settings at any time. If Precise Location is disabled, the App may still collect and use approximate location information (e.g., city or region), but your profile will not appear with exact location details.

8.2 Consent & Control

We request your consent before accessing Precise Location. You may withdraw consent or adjust location preferences at any time in device or in-app settings. Disabling location services may limit features.

8.3 Data Retention

Location data is retained only as long as necessary to provide services, then deleted or anonymized.

8.4 Third-Party Sharing

We may share location data with trusted providers (e.g., map or analytics services) solely to deliver features. We do not sell location data.

8.5 Children’s Privacy

We do not knowingly collect Precise Location data from children under 13. If collected inadvertently, it will be deleted promptly.

9. Safety & Risk

  • Outdoor activities involve risks of injury, illness, or death. You assume all risks.

  • Day Hike does not provide medical advice. Consult a physician before starting new physical activities.

  • The App is not a substitute for emergency communication devices (e.g., 911, satellite beacons).

  • When meeting other users, you are solely responsible for precautions and interactions.

10. Indemnification

You agree to indemnify and hold harmless Day Hike, its affiliates, officers, employees, and licensors from claims or damages arising from your use, your content, or your interactions with others.

11. Payments & Subscriptions

Some features require payment. By purchasing or subscribing, you agree:

  • Payments are processed through the Apple App Store or Google Play. Their terms govern billing, renewals, and refunds.

  • Subscriptions auto-renew unless canceled through your App Store/Google Play account at least 24 hours before renewal.

  • Refunds are provided only as required by law or under App Store/Google Play policies.

12. Third-Party Services

Day Hike may link to third-party sites or services. We are not responsible for their content, privacy, or practices.

13. Termination

We may suspend or terminate your account for violation of these Terms or at our discretion. Upon termination, licenses granted to you end immediately. Sections on arbitration, indemnification, limitations, and IP survive termination.

14. Disclaimer of Warranties

Day Hike Technology is provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness, and non-infringement.

15. Limitation of Liability

To the maximum extent permitted by law, Day Hike is not liable for indirect, incidental, or consequential damages, lost profits, or data loss arising from your use.

16. Data Protection & Privacy Rights

Day Hike complies with GDPR, CCPA/CPRA, and other data protection laws.

16.1 Data Collection

We collect information you provide (e.g., name, email, location), and technical usage data.

16.2 Data Use

Used to provide services, improve features, communicate with you, and comply with laws.

16.3 Data Rights

  • Access, correction, deletion, portability, and restriction rights under GDPR/CCPA.

  • California residents have the right to opt-out of “sale” or “sharing” of data. Day Hike does not sell personal data.

  • Requests can be made via support@dayhike.com.

16.4 Data Breach

If a data breach occurs, Day Hike will notify affected users and regulators as required by law.

16.5 Data Security

We use appropriate safeguards against unauthorized access, alteration, or loss.

16.6 International Transfers

Data may be processed in other countries with adequate safeguards.

17. Marketing

You may receive promotional communications. You can opt-out at any time via provided instructions or support@dayhike.com.

18. Beacon Feature

The “Beacon” feature allows social location sharing. It is not intended for emergencies and may not be accurate or real-time. Do not rely on it for safety.

19. Social Features

Social tools allow user interaction. You agree not to harass, bully, or misuse these features. Day Hike may moderate or remove content.

Day Hike Technology may include social features that allow you to interact with other users, share content, and participate in group activities. By using the social features, you agree to:

  • Use these features responsibly and respect the rights and privacy of other users.

  • Not engage in any harassment, bullying, or inappropriate behavior.

  • Comply with all applicable laws and regulations when using the social features.

Day Hike does not pre-screen user content and is not responsible for the actions or conduct of other users. We reserve the right to remove content or restrict access if you violate these Terms.

19.1 Indemnification for Social Issues

You agree to indemnify and hold harmless Day Hike and its affiliates from claims arising from your social feature use, interactions, or disputes with other users.

19.2 Trail Crush Feature

Day Hike includes a feature called Trail Crush, designed to make it easier for users to send and receive friend requests in a light and playful way. Trail Crush is intended as a social connection tool and may be used for friendship, hiking partnerships, or casual social interactions. It is not intended to be a dating service or matchmaking platform.

By using Trail Crush, you acknowledge and agree to the following:

  • Purpose & Use: Trail Crush allows you to send a signal to another user indicating interest in connecting. This may be interpreted as a friendly nudge, a social invitation, or light flirting, depending on the context. Day Hike does not mediate or guarantee the nature of any connections formed.

  • User Control: You may enable or disable Trail Crush at any time in your account settings. When disabled, other users cannot send you Trail Crush requests. Disabling Trail Crush does not affect access to other Day Hike features.

  • Consent & Interactions: Sending a Trail Crush does not guarantee a response or connection. Users are expected to engage respectfully and responsibly. Harassment, unwanted repeated Trail Crush requests, or inappropriate behavior is strictly prohibited.

  • Data Privacy: Trail Crush activity (such as who you have sent or received requests from) is private and not publicly displayed. Day Hike does not sell this data to third parties. Your use of Trail Crush is governed by our Privacy Policy, including rules on location data, visibility, and deletion rights. You can also customize or disable your location sharing and visibility preferences in the App’s settings at any time.

  • Non-Romantic Use: Trail Crush is not exclusively for romantic connections. It may also be used to initiate friendships or outdoor activity partnerships. Users decide the context of their interactions.

  • Safety Disclaimer: Day Hike is not responsible for the outcome of any Trail Crush interactions or relationships that develop through the feature. Exercise caution when meeting new people, and follow the Safety & Risk guidelines in these Terms.

Day Hike reserves the right to suspend or disable access to Trail Crush for any user who misuses the feature or violates these Terms, including harassment, spamming, or unsafe conduct.

Data Privacy:

20. Reporting Misuse & Emergencies

Misuse reports may be sent to support@dayhike.com. In emergencies, call 911 or your local services.

21. Commercial & Professional Use

If using Day Hike for guided or professional services, you must comply with applicable laws, licenses, and permits. Day Hike does not verify professional status.

22. Activities & Events

Participation in activities or events listed by Day Hike is voluntary and at your own risk. Third-party events are not controlled by Day Hike.

23. Arbitration & Governing Law

  • Agreement to Arbitrate: Disputes will be resolved by binding arbitration under AAA rules in Jackson, Wyoming.

  • Small Claims Exception: Either party may pursue claims in small claims court.

  • Class Action Waiver: Disputes will be resolved individually, not as part of a class.

  • Costs: Each party bears its own costs, unless awarded otherwise by law.

  • Survival: Arbitration and governing law provisions survive termination.

  • Governing Law: Wyoming law governs these Terms.

24. Export Controls & Sanctions

You may not use Day Hike if you are in a country subject to U.S. embargoes or on government restricted-party lists.

25. Accessibility & Non-Discrimination

Day Hike does not discriminate on the basis of race, color, religion, sex, gender, national origin, disability, or other protected status. We are committed to accessibility compliance.

26. Changes to Terms

We may update these Terms at any time. Material changes will be notified at least 30 days before taking effect. Continued use means you accept updated Terms.
